Wondering how to put together a Data Sharing Agreement? We can help!

Our Data Sharing Agreement Checklist summarizes the requirements for the written agreements under the audit or evaluation exception that is specified in FERPA and that also applies to the IDEA for Part C early intervention and Part B 619 preschool special education. This 2014 document is an adaptation of the Privacy Technical Assistance Center’s 2012 release of Checklist: Data Sharing Agreement, intended for K-12 audiences.

Specific areas addressed in the document include:

  • Mandatory elements
  • Best Practices
  • Additional Resources
  • Glossary
  • FERPA and IDEA Definitions

You can find the Data Sharing Agreement Checklist in our DaSy Resources under Publications, or directly at http://dasycenter.org/data-sharing-agreement-checklist-for-idea-part-c-and-part-b-619-agencies-and-programs-2/.

When using the document, bear in mind that it is meant to provide an orientation to these laws and should not be considered legal advice or a substitute for legal counsel. The goal of this document is to give the reader enough information to ask good questions and gather the appropriate information prior to seeking official guidance.
